A BETTER LAWYER

Autumn Paine (formerly HajMohammad) earned her Juris Doctor, with distinction, from the University of the Pacific, McGeorge School of Law in Sacramento. While a full-time student she clerked for the California Chamber of Commerce, and then the Sacramento County District Attorney's Office as well as the McGeorge Civil Practice Clinic.  She graduated with honors and was granted membership into the presigious Traynor Honor Society.

She began her career at the Kern County Public Defender's Office in Bakersfield, CA where she represented clients in jury trials, plea negotiations, and  petitions for writs of habeas corpus.

In 2008, Autumn Paine moved her practice to Oakland, where she continues to aggressively advocate for those charged or convicted of crimes.

BETTER RESULTS

Assault w/GBI - Not Guilty!

The prosecutor alleged this 19 year old young woman with no prior criminal record had, along with a friend, brutally beaten a home-less man. While the prosecutor relied on tragic photos of the victim's injuries, Ms. Paine critically examined the testimony of the six witnesses, resulting in a not-guilty verdict.

Cultivation of Marijuana -
Case Dismissed!

The State charged this man with cultivation when a neighbor turned him in.  The police seized forty-five plants and related equipment. The prosecutor was not even aware of the co-op law which allowed this man and his housemate to grow for personal use.  The court dismissed all charges after Ms. Paine developed the facts at a preliminary hearing which showed this man was well within his legal rights.

THE PRACTICE

The practice is limited to criminal defense.

The practice encompasses all aspects of criminal defense and provides complete representation in criminal cases including:

  • counsel prior to the filing of charges
  • pretrial negotiations
  • pretrial motions (for example, motion to suppress)
  • jury trial
  • petitions for writ relief (for example, habeas corpus)
  • post-conviction relief, including 1203.4 motions (commonly referred to as expungements), certificates of rehabilitation, etc.
  • post-conviction appeals.
